1. Acceptance of these Terms

By using PlusReserva you fully accept these Terms of Service. If you do not accept them, please do not use the platform.

2. What is PlusReserva

PlusReserva is a platform that connects people offering a bookable paid service ("host") with people who want to book it ("guest"), automatically handling the calendar, payments and confirmations. PlusReserva acts exclusively as a technology intermediary: the contract for providing the service is concluded directly between host and guest, and PlusReserva does not itself provide the services published in the listings.

4. Eligibility requirements

To use PlusReserva you must be at least 18 years old and have the legal capacity to enter into binding contracts under the law applicable to you. By registering you declare that the information you provide is truthful, complete and up to date.

5. Registration and account

Registration and sign-in to PlusReserva happen through your OmegaMaria ID ("Sign in with OmegaMaria ID"): PlusReserva does not manage your password directly, which stays protected on your OmegaMaria ID.

• You may create only one personal account and are responsible for keeping your login credentials confidential.
• You are responsible for all activity carried out through your account.
• If you suspect unauthorized access to your account, notify us immediately.
• We reserve the right to suspend accounts with false, incomplete or unverifiable information.

6. If you publish a listing (host)

• You are solely responsible for the accuracy, legality and actual availability of what you offer in your listing (description, photos, price, availability).
• You must hold any license, authorization or permit that may be required by the law applicable to the service you offer.
• To receive payments for bookings you must connect a Stripe account via Stripe Connect: PlusReserva does not process payments through alternative methods.
• You agree to honor confirmed bookings on your listing.

7. If you book (guest)

• You agree to pay the price shown at the time of booking, using the payment methods available on the platform.
• We recommend carefully checking the listing details before confirming a booking.
• You agree to respect the terms of the service agreed upon with the host.

8. Prices, payments and service fee

• The price of each listing is freely set by the host.
• Payment is processed entirely by Stripe at the time of booking; PlusReserva never has access to your card details.
• PlusReserva retains a service fee equal to 5% of the amount of each booking; the remaining 95% is automatically transferred to the host via Stripe.

9. Cancellations and refunds

• A confirmed booking can be cancelled by the guest or by the host, as long as it has not yet been completed.
• In the event of cancellation, the guest is refunded 95% of the amount paid (the host's share); the 5% withheld as a service fee is never refundable, regardless of who cancels the booking.
• Any additional cancellation terms specific to the service (e.g. notice periods, penalties) are the host's responsibility and must be clearly stated in the listing or agreed directly with the guest.

10. Content published by users

• You are responsible for the content you publish on the platform (text, images, prices and any other information).
• By publishing content you grant PlusReserva a non-exclusive, royalty-free license to display it on the platform, to the extent necessary to provide the service.
• You may not publish content that infringes third-party rights (including intellectual property) or that is false, misleading, offensive or illegal.

11. Prohibited conduct

• Using the platform for unlawful, fraudulent or unauthorized purposes.
• Circumventing the platform's payment system to avoid the service fee.
• Creating multiple accounts to evade a suspension or restriction.
• Uploading false, misleading content or content that infringes third-party rights.
• Attempting to gain unauthorized access to other users' systems, accounts or data.

12. PlusReserva's role and limitation of liability

PlusReserva provides the platform "as is" and does not guarantee that the service will always be available, uninterrupted or error-free. Being a technology intermediary unrelated to the direct relationship between host and guest, PlusReserva is not responsible for the quality, safety, legality or actual performance of the service offered by the host. To the extent permitted by applicable law, PlusReserva's liability for any damages arising from use of the platform is limited to the amount of the service fee actually received in connection with the booking concerned.

13. Suspension and closure of the account

• We may suspend or deactivate an account in the event of a violation of these Terms, suspected fraudulent activity, or at the request of the competent authorities.
• You can request deactivation of your account at any time by contacting us.

14. Changes to the service and to these Terms

We may update the service's features or these Terms over time. Substantial changes will be communicated to you with reasonable notice; continued use of PlusReserva after the update constitutes acceptance of the new Terms.

15. Governing law

These Terms are governed by the law applicable to the controller of the service. If you reside in the European Union as a consumer, you still retain the benefit of the mandatory consumer protection rules provided by the law of your country of residence.
